It has been almost a month of implementation of full operation of the Hotel Industry, there were a lot of questions being raised by the Hotel Owners as well as the Employees of each Hotel.
Therefore, on the 31st of October, DOLE USec Benjo M. Benavidez clarified the directions given to the hotels in the Department order No. 215 Series of 2020 “Labor Code on Suspension of Employment Relationship ”, and payment of 13th Month Pay.
He explained that the Labor Code on Suspension of Employment Relationship is prior to the bona-fide suspension of the operation of a business or undertaking for a period not exceeding six (6) months, or the fulfillment of the employee of a military or civic duty shall not terminate employment.
Furthermore, He also emphasized that the 13th month pay is the one-twelfth (1/12) of the basic salary of an employee within a calendar year. “So Hotel owners shouldn’t be scared of giving that. Kung ano lang yung month na pinasok times the salary divided by 12 yun ang 13th month pay nila” says USec. Benavidez.
